By accessing or using the B\u00f3kun API, you agree to this B\u00f3kun API License and Terms of Use (the \u201cB\u00f3kun API Terms\u201d) with Tripadvisor LLC dba B\u00f3kun (\u201cwe\u201d, \u201cour\u201d, \u201cus\u201d or \u201cB\u00f3kun\u201d). B\u00f3kun reserves the right to update and change the B\u00f3kun API Terms by posting updates and changes here: https:\/\/www.bokun.io\/legal\/api-terms<\/a>. <\/p>\n

1. Definitions<\/h3>\n

\u201cApplication\u201d or \u201cApp\u201d means the software application, website, interface or any other means you use to access the B\u00f3kun API.<\/p>\n

\u201cAPI Credentials\u201d means the credentials that allow you to make authenticated requests to the B\u00f3kun API. <\/p>\n

\u201cB\u00f3kun API(s)\u201d means the application programming interface, in whatever form or medium, and as may be updated from time to time, that are made available by B\u00f3kun at https:\/\/bokun.dev<\/a> or that are otherwise provided to you. <\/p>\n

\u201cB\u00f3kun App Store\u201d is where Vendors can view and install Apps, and is available through https:\/\/appstore.bokun.io<\/a>. <\/p>\n

\u201cB\u00f3kun App Store Partner Account\u201d means an account held by a member of the B\u00f3kun Partner Program.<\/p>\n

\u201cB\u00f3kun App Store Partner Agreement\u201d means the terms and conditions governing a B\u00f3kun Partner\u2019s participation in the B\u00f3kun App Store Partner Program. <\/p>\n

\u201cB\u00f3kun Partner\u201d means an individual or entity that has agreed to the terms of the B\u00f3kun App Store Partner Program Agreement in order to participate in the B\u00f3kun Partner Program.<\/p>\n

\u201cB\u00f3kun Partner Program\u201d means the program through which B\u00f3kun makes certain resources, products, services and connections available to B\u00f3kun Partners.<\/p>\n

\u201cB\u00f3kun Service\u201d means B\u00f3kun\u2019s online booking services, marketplace, channel management, and any associated websites, products, services and Applications offered by B\u00f3kun.<\/p>\n

\u201cB\u00f3kun Services Agreement\u201d means B\u00f3kun\u2019s standard Services Agreement as accessed through https:\/\/www.bokun.io\/terms<\/a> or such other link that B\u00f3kun may use from time to time.<\/p>\n

\u201cCustomer\u201d means any individual that visits or transacts via a Vendor Site.<\/p>\n

\u201cCustomer Data\u201d means information (including Personal Information) relating to a Customer, including order information, payment information, or account information.<\/p>\n

\u201cUser Account\u201d has the meaning set out in the B\u00f3kun Services Agreement.<\/p>\n

\u201cVendor\u201d or \u201cUser\u201d means an individual or business that uses the B\u00f3kun Service to promote and\/or sell travel and touristic services.<\/p>\n

\u201cVendor\/Partner Agreement\u201d means the agreement entered into between a B\u00f3kun Partner and a Vendor governing the Vendor\u2019s use of the Partner\u2019s services, including, if applicable, the installation and use of an Application.<\/p>\n

\u201cVendor Data\u201d means information (including Personal Information) relating to a Vendor or Vendor Store, including business, financial and product information and any Customer Data.<\/p>\n

\u201cVendor Site\u201d means a Vendor\u2019s website or other medium or channel on which a Customer may transact with such Vendor through use of the B\u00f3kun Service.<\/p>\n

\u201cUpdates\u201d means bug fixes, updates, upgrades, enhancements, modifications and new releases or versions of the B\u00f3kun API.<\/p>\n

2. Using the B\u00f3kun API<\/h3>\n

2.1 Access to the B\u00f3kun API<\/h4>\n

2.1.1 You may not use the B\u00f3kun API and may not accept the B\u00f3kun API Terms if (a) you are not of legal age to form a binding contract with B\u00f3kun, and\/or (b) you are not permitted to use the B\u00f3kun API under applicable law.<\/p>\n

2.1.2\tIf you are accessing or using the B\u00f3kun API on behalf of a corporate entity, you represent and warrant that you have the authority to bind that entity to the B\u00f3kun API Terms and by accepting the Terms, you are doing so on behalf of that entity (and all references to \u201cyou\u201d in the B\u00f3kun API Terms refer to that entity).<\/p>\n

2.1.3\tExcept as permitted herein, (A) you must keep the API Credentials and all login information for your User Account and\/or Partner App Store Partner Account secure, (B) you may not share the API Credentials with any third party, and (C) you will not access the B\u00f3kun API by any means other than the API Credentials. API Credentials are the exclusive property of B\u00f3kun, and your access to and use of API Credentials is in B\u00f3kun\u2019s sole discretion.<\/p>\n

2.1.4\tYou are not permitted to use a service provider in connection with providing your Application\u2019s service unless they sign an agreement with you to (A) protect any Vendor Data received from B\u00f3kun (that is at least as protective as B\u00f3kun\u2019s terms and policies), (B) limit their use of Vendor Data solely for the purpose of (a) providing their services to your Application and\/or (b) facilitating your use of the B\u00f3kun Service (and not for the service provider\u2019s own purpose or any other purpose), and (C) keep the Vendor Data secure and confidential. You must ensure that any service provider complies with these B\u00f3kun API Terms and any other applicable B\u00f3kun terms and policies, and you acknowledge and agree that any act or omission by a service provider amounting to a breach of these B\u00f3kun API Terms will be deemed to be a breach by you. If requested, you will provide a list of your service providers to B\u00f3kun or (in the case of your providing an App to a Vendor) the applicable Vendor.<\/p>\n

2.2 API License<\/h4>\n

Subject to the B\u00f3kun API Terms, B\u00f3kun grants you a worldwide, non-exclusive, royalty-free, non-transferable, non-sublicensable, revocable and limited license to use and make calls to the B\u00f3kun API solely in connection with (a) using the B\u00f3kun Service, and\/or (b) developing, implementing and distributing your Application that interoperates or integrates with the B\u00f3kun Service, and in each case solely in the manner described in the B\u00f3kun API Terms and in the technical documentation contained in the B\u00f3kun API.<\/p>\n

2.3 API Restrictions<\/h4>\n

You will (and will ensure that your employees, agents and service providers will):<\/p>\n

2.3.1\tonly use the B\u00f3kun API to develop and distribute Applications or content fora Vendor\u2019s use with the B\u00f3kun Service or, if you are a Vendor, for your own use of the B\u00f3kun Service;<\/p>\n

2.3.2\trestrict disclosure of the API Credentials, or any part thereof, to your agents, employees, or service providers, who either (A) need access to facilitate your use of the B\u00f3kun Service, or (B) need access to use, maintain, implement, correct or update your Application, in each case (a) solely in accordance with the B\u00f3kun API Terms, and (b) who are subject to confidentiality obligations the same as or greater than those contained herein;<\/p>\n

2.3.3\tnot distribute, sell, lease, rent, lend, transfer, assign or sublicense any rights granted by the B\u00f3kun API Terms to any third party;<\/p>\n

2.3.4\tnot use or access the B\u00f3kun API or the B\u00f3kun Service in order to monitor the availability, performance, or functionality of the B\u00f3kun API, the B\u00f3kun Service or any portion thereof or for any similar benchmarking purposes;<\/p>\n

2.3.5\tnot remove or destroy any copyright notices, proprietary markings or confidentiality notices placed upon, contained within or associated with the B\u00f3kun API;<\/p>\n

2.3.6\tnot engage in any activity that interferes with, disrupts, harms, damages, or accesses in an unauthorized manner the servers, security, networks, data, applications or other properties or services of B\u00f3kun or any third party;<\/p>\n

2.3.7\tnot circumvent technological measures intended to prevent direct database access, or manufacture tools or products to that effect;<\/p>\n

2.3.8\tnot modify, translate, reverse engineer, disassemble, reconstruct, decompile, copy, or create derivative works of the B\u00f3kun API, Vendor Data, any Vendor Site, the B\u00f3kun Services, or any aspect or portion thereof, except to the extent that this restriction is expressly prohibited by applicable law;<\/p>\n

2.3.9\tnot bypass B\u00f3kun API restrictions for any reason;<\/p>\n

2.3.10\tnot, except as authorized by B\u00f3kun in writing, substantially replicate products or services offered by B\u00f3kun, including the B\u00f3kun API;<\/p>\n

2.3.11\tnot develop Applications that excessively burden B\u00f3kun\u2019s system, or that distribute spyware, adware or other similar programs;<\/p>\n

2.3.12\tnot develop an Application whose primary purpose is to migrate a Vendor away from B\u00f3kun;<\/p>\n

2.3.13\tnot access or use the B\u00f3kun API to develop or distribute the Application in any way in connection with any criminal, fraudulent, or other unlawful activity;<\/p>\n

2.3.14\tnot request more than the minimum amount of data from a B\u00f3kun API needed either (a) to use the B\u00f3kun Service or (b) by your Application to provide the Vendor the intended Application functionality;<\/p>\n

2.3.15 not promote yourself or your Application by using or bidding for search-based or keyword-based advertising using \u00abB\u00f3kun\u00bb, any other B\u00f3kun trademarks or brand features, or any misspellings or alterations thereof;<\/p>\n

2.3.16\tnot falsify or alter any unique identifier in, or assigned to your Application, or otherwise obscure or alter the source of queries coming from an Application; and<\/p>\n

2.3.17\tnot include code in any Application which performs any operations not related to the services provided by the Application, whether or not you have obtained a Vendor\u2019s consent to do so, and whether or not your Application obtains consent from the end user to do so. For the avoidance of doubt, this prohibited activity includes embedding or incorporating code into any Application which utilizes the resources (including CPU resources) of another computer.\ufeff<\/span><\/p>\n

2.4 API Limits<\/h4>\n

B\u00f3kun may set and enforce limits on your use of the B\u00f3kun API, in our sole discretion. You agree to, and will not attempt to circumvent such limitations. <\/p>\n

2.5 Open Source Software<\/h4>\n

Some of the software packages, libraries, or components required by or included in the B\u00f3kun API are or may become licensed under an open source software license (\u201cOpen Source Components\u201d). To the limited extent that the Open Source Component license expressly supersedes the B\u00f3kun API Terms, your use, reproduction and distribution of any such Open Source Components is governed by the terms of the applicable open source software license and not this Section 2.5.<\/p>\n

3. Changes to the B\u00f3kun API<\/h3>\n

3.1 Updates
\nB\u00f3kun reserves the right to require you to install or update any and all software to continue using the B\u00f3kun API and\/or the B\u00f3kun Service. You acknowledge that B\u00f3kun may make Updates to the B\u00f3kun API from time to time, and at its sole discretion. You must implement and use the most current version of the B\u00f3kun API and, if applicable, to make any changes to your Application that are required as a result of such Update, at your sole cost and expense. Updates may adversely affect the manner in which your Application accesses or communicates with the B\u00f3kun API, or the manner in which you may make use of the B\u00f3kun Service. Your continued access or use of the B\u00f3kun API following an update or modification will constitute binding acceptance of the Update.<\/p>\n

3.2 Access and Use
\nWe may change or discontinue the availability of some or all of the B\u00f3kun APIs at any time for any reason with or without notice. Such changes may include removal of features, or the requirements of fees for previously free features. We may also impose limits on certain features and services or restrict your access to some or all of the B\u00f3kun API. Your continued use of the B\u00f3kun API following a subsequent release will be deemed your acceptance of modifications.<\/p>\n

4. Proprietary Rights<\/h3>\n

4.1\tThe B\u00f3kun Service, the B\u00f3kun API, and all software, documentation, information, hardware, equipment, devices, templates, tools, documents, processes, methodologies, know-how, websites and any additional intellectual or other property used by or on behalf of B\u00f3kun or otherwise related to the B\u00f3kun Service, together with all copyrights, trademarks, patents, trade secrets and any other proprietary rights inherent therein and related thereto (collectively, \u201cB\u00f3kun Property\u201d) will be and remain the sole and exclusive property of B\u00f3kun. To the extent, if any, that ownership of any B\u00f3kun Property does not automatically vest in B\u00f3kun by virtue of the B\u00f3kun API Terms, or otherwise, and vests in you, you hereby transfer and assign to B\u00f3kun, upon the creation thereof, all rights, title and interest you may have in and to such B\u00f3kun Property (and waive any and all moral rights, as applicable), including the right to sue and recover for past, present and future violations thereof.<\/p>\n

4.2\tBy using the B\u00f3kun API, you do not acquire ownership of any rights in the B\u00f3kun APIs or the content that is accessed through the B\u00f3kun APIs<\/p>\n

5. Security<\/h3>\n

5.1\tYou agree that B\u00f3kun may monitor use of the B\u00f3kun API to ensure quality, improve B\u00f3kun products and services, and verify your compliance with the B\u00f3kun API Terms. This monitoring may include B\u00f3kun accessing and using your Application, for example to identify security issues that could affect B\u00f3kun or Vendors. You are prohibited from interfering with this monitoring. <\/p>\n

5.2\tYour Application will be installed and run on your server or another server, but will not be run on B\u00f3kun\u2019s servers. Your networks, operating system and software of your web servers, routers, databases, and computer systems (collectively, \u201cYour System\u201d) must be properly configured to Internet industry standards so as to securely operate your Application and protect against unauthorized access to, disclosure or use of any information you receive from B\u00f3kun, including Vendor Data. You must immediately correct any security deficiency, and disconnect immediately any known or suspected intrusions.<\/p>\n

6. Audit<\/h3>\n

B\u00f3kun shall have the right to audit, or to appoint an independent auditor to audit your App, systems and records to confirm your compliance with the B\u00f3kun API Terms, including without limitation your compliance with B\u00f3kun\u2019s requests and requests from Vendors or Customers, as applicable, to delete Vendor Data obtained through the B\u00f3kun API or otherwise through the B\u00f3kun Services. If requested, you must provide us with proof that your Application complies with these B\u00f3kun API Terms.<\/p>\n

7. Disclaimer<\/h3>\n

The B\u00f3kun API is provided \u201cas-is\u201d. B\u00f3kun makes no warranties hereunder, and B\u00f3kun expressly disclaims all warranties, express or implied, including warranties of non-infringement, merchantability and fitness for a particular purpose. Without limiting the foregoing, B\u00f3kun further disclaims all representations and warranties that the B\u00f3kun API satisfies any or all of your or any Vendor\u2019s requirements, or will be uninterrupted, error-free or free from harmful components.<\/p>\n

8. Suspension and Termination<\/h3>\n

Access to the B\u00f3kun API may be terminated or suspended by B\u00f3kun at any time and at B\u00f3kun\u2019s sole discretion. Without limiting the foregoing, B\u00f3kun may terminate your right to use the B\u00f3kun API if you breach the B\u00f3kun API Terms or the B\u00f3kun Partner Agreement or B\u00f3kun Services Agreement. Termination or suspension of your access to the B\u00f3kun API may negatively affect Vendors who use your Application, and you are responsible for ensuring that all Vendors who access or use your Application are aware of this risk.<\/p>\n","protected":false},"excerpt":{"rendered":"
